If the state that your RHC is located in ends the State of Emergency the end of June or first part of July, do we lose the ability to perform Telehealth visits as the distant site then? 6/28/2021 @ 3:04:00 PM

My understanding is that telehealth services are tied to the federal emergency response, not at the state level

The CMS waiver allowing RHCs to bill Medicare as the distant site (provide telehealth services) is tied to the federal emergency declaration and should not be impacted by changes at the state level. However, if your state only granted RHCs the ability to bill Medicaid as the distant site during the PHE, then this would be impacted by the ending of the state's emergency declaration and you would have to review how the initial waiver was written (i.e. does it say "until the end of the PHE") to be sure. If RHCs in your state could bill Medicaid for telehealth distant site services prior to the PHE, then it won't be impacted. Be sure to look for any waivers that your state Medicaid released during the PHE (such as allowing new services, allowing phone visits, etc.) for what would be impacted if the state declares an end to the state-specific PHE.
