Nathan,

Did you ever find the 2018 list of codes for the RHC Modifier HCPCS Conflicts?

Also, any update on this issue in regards to answers from CMS, etc.?

I did check the 2021 Updates and there have been no new codes added to this list.

CMS created a "RHC Modifier HCPCS Conflict Additions" list in April of 2018.

If a code is on this list, it means that CMS has told the MACs to reject claims with that code and modifier CG. The end policy is that CMS has determined that these services DO NOT meet the definition of a RHC encounter. NARHC is gathering all relevant information on this issue and will be pursuing this issue further with CMS. We may need to contest CMS determinations on a code-by-code basis. 

I believe 7 codes were on this list in 2018 and then 11 more were added through the course of 2020 for a total of 18 HCPCs codes on this list. Right now, I only have the 11 codes added in 2020 but I am working to identify the other 7.

11721 was added to this list in July so I am not surprised you are getting a rejection. We will post a full list (with code descriptions) when we have it on our website. These are the 11 codes added to the list in 2020:

Nathan,

What do you recommend we do for past and future claims?  Should we continue to submit them and hope that these procedures are removed from the conflict list?  I think someone asked if we could change these to an E/M code, but not sure I seen an answer?

Good news! As we were hoping, CMS will remove the below codes from the RHC Conflict Add-On list on April 1!

As a refresher, because of this "RHC Conflict Add-On List," if these codes were the primary reason for the visit and billed on their own with Modifier CG, the MACs were told to reject these claims.

Beginning in April, RHCs will once again be able to bill for the following services, append the CG modifier, without any other services on the claim, and be paid the All-Inclusive Rate for these minor procedures. 

I want to thank Patty Harper, Shannon Chambers, Gary Lucas, Dr. Keith Davis for helping NARHC make the case to CMS and get this issue fixed.
